Scorecard in Weekly Outcomes for Patent Litigation

We’ve added a new scorecard that appears at the top of every non-settled case in the report and shows the number of Accusations that were won, lost, settled or dismissed for non-merits reasons. This way, users can easily see what combination of Accusation Outcomes led to the overall Case Outcome.

HOW THIS HELPS YOU

Peek under the hood behind each “win” or “loss,” as we now break apart the underlying combination of party outcomes used to generate the single, consolidated “Case Outcome.” This makes it easier to understand on-the-fence rulings, such as when the parties “dismiss” each of the claims in a proceeding, but one patent was found unpatentable after a stay pending IPR (something we classify as a “related case Patent Challenger win”).

HOW TO USE THE TOOL

Simply open the Weekly Outcomes for Patent Litigation report, and you’ll be greeted by the scorecard for each USDC “win” or “loss.”

Non-Merits Dismissals in Weekly Outcomes for Patent Litigation

We’ve added a new classification of Case Outcomes for the US District Courts: Non-Merits Dismissals. We enter these when every non-settled Accusation Outcome was dismissed for procedural reasons (i.e., not on the merits of the patent claims), such as for lack of jurisdiction.

HOW THIS HELPS YOU

Granularity gives meaning, and we believe further breaking down Case Outcomes into meaningful bites will help litigators understand at a glance what happened under the hood in a case.
