In this report we’ll take a look at patent litigation in 2017 including:

• Trends in Patent Litigation Activity – Most indicators suggest patent litigation activity in U.S. district courts has returned to approximately 2010 levels.
• The Key Participants in Patent Litigation – Uniloc filed more new Patent Cases than any other company, but Yeti Coolers, LLC asserted the most Patent Accusations — more than twice as many as Uniloc.
• Decision Trends – Section 101 challenges are more often denied in TXED than any other court. Following TC Heartland, TXED also denies more than half of all venue challenges while all other courts deny about a third.
• Trends in the PTAB – At the institution stage, the success rates of patentability challenges under § 101, and § 102 declined sharply, while the success rate of §103 challenges increased.
